1. Introduction
These Terms of Use govern your access to and use of the OcuTriage platform (‘Platform’). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. About OcuTriage
OcuTriage is a digital symptom collection and documentation platform designed for use by optical practices. It assists users in collecting structured patient symptom information and generating reports for review by a qualified optometrist. OcuTriage does not diagnose medical conditions, determine clinical urgency, recommend treatment or replace professional clinical judgement.
3. Eligibility
The Platform is intended for use by registered optical practices and authorised personnel, including optometrists, dispensing opticians and optical support staff. Organisations are responsible for ensuring that only authorised users access the Platform.
4. User Accounts
Users must keep login credentials secure and must not share accounts with unauthorised individuals. Practices are responsible for all activity carried out using their accounts and must notify OcuTriage promptly if they suspect unauthorised access.
5. Acceptable Use
Users must use the Platform lawfully and only for its intended purpose. Users must not attempt to gain unauthorised access, interfere with the Platform, upload malicious software, misuse patient information or knowingly enter false information.
6. Clinical Responsibility
OcuTriage is a documentation tool only. All assessment, diagnosis, urgency decisions, referrals, treatment and follow-up remain the responsibility of the registered optometrist reviewing the patient. OcuTriage must not be relied upon as a substitute for professional clinical judgement.
7. Accuracy of Information
Reports generated by OcuTriage are based entirely on information entered by users. Users remain responsible for ensuring that information entered into the Platform is accurate and complete.
8. Data Retention
Patient triage information is stored temporarily on OcuTriage’s servers solely for the purpose of generating the report. All patient information is automatically and permanently deleted from OcuTriage’s servers after 30 minutes. Practices are responsible for downloading and securely retaining any reports required for their own clinical records.
9. Intellectual Property
All intellectual property rights in the Platform, including its software, branding, question pathways, documentation and content, remain the property of OcuTriage Limited. Practices retain ownership of their own patient information and generated reports.
10. Availability
OcuTriage aims to provide reliable access but does not guarantee uninterrupted availability. The Platform may be temporarily unavailable due to maintenance, security updates or circumstances outside our reasonable control.
11. Limitation of Liability
To the fullest extent permitted by law, OcuTriage shall not be liable for clinical decisions made by users or for losses arising from inaccurate information entered into the Platform. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence or for fraud.
12. Data Protection
OcuTriage processes personal information in accordance with the UK GDPR, the Data Protection Act 2018 and its Privacy Policy. Practices remain responsible for complying with their own professional and legal obligations regarding patient records.
13. Suspension and Termination
OcuTriage may suspend or terminate access where these Terms are breached, security risks arise or continued access would be unlawful.
14. Changes to these Terms
We may update these Terms from time to time. Updated versions will be published on our website and will take effect from the date of publication. Continued use of the Platform constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
